Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Luhemusa Solutions ("we", "us") for the use of the PostAi mobile app (the "App") and this website. By downloading or using the App you accept these Terms, our Privacy Policy and, if you subscribe, our Subscription Terms. If you use PostAi for a business, you confirm that you can accept these Terms on its behalf. If you don’t agree, don’t use the App.

2. The service

PostAi offers two main features:

• AI posts: from 20+ templates, PostAi uses artificial intelligence to create Instagram images (post, portrait, story, reel cover and carousel slide formats), captions and hashtags in six languages.
• Comment automation: after you connect an Instagram professional account, PostAi applies the rules you set (keywords or any comment, on all posts or one post) to reply publicly to comments and/or send one private message (DM) to the person who commented. Reply and DM texts are written by you or drafted by AI when you set up the rule; PostAi does not generate new text for each comment.

PostAi is available on a Free plan and on paid plans (Starter and Pro), described in section 8 and in the Subscription Terms.

3. Eligibility

You must be at least 13 years old, or 16 in the European Economic Area and the United Kingdom (or the minimum age of digital consent in your country), and old enough to enter into a binding agreement where you live. If you are a minor, a parent or guardian must agree to these Terms and approve any purchase.

4. Your identity in the App

PostAi does not use a traditional login. The App creates an anonymous identifier on your device. You are responsible for the device you use. If you connect an Instagram account, you can use it to recover your plan and automations on a new device (Profile › Recover my account). If you never connected Instagram, we may not be able to recover your data if you lose your device or uninstall the App.

5. Instagram accounts and automations

a. Comment automation requires an Instagram professional account (Business or Creator). You connect it through Meta’s official login screen and authorize PostAi to read your profile and posts, manage comments and send messages on your behalf. You must own the account or be authorized to manage it.

b. You are responsible for using Instagram in compliance with Instagram’s Terms of Use, Community Guidelines and Promotion Guidelines, Meta’s policies and the laws that apply to you, including consumer protection, advertising, privacy and anti-spam laws. If you run a giveaway, you are responsible for its official rules and for complying with Instagram’s rules on promotions.

c. You are responsible for the content of your automated replies and DMs. They must not be spam, misleading, offensive, illegal or otherwise prohibited, and must not infringe anyone’s rights. We check reply and DM texts with automated moderation and may block texts or rules that break these Terms.

d. PostAi is an independent tool. It is not affiliated with, endorsed or sponsored by Meta or Instagram. Instagram is a trademark of Meta Platforms, Inc.

6. Meta limits and availability

a. Automations depend on Meta’s Instagram API and are subject to its limits and rules. For example, Meta limits the number of messages an account can send per hour and allows only one private reply per comment, within 7 days of the comment. When a limit is reached, replies may be delayed or not sent. Automations currently respond to comments on your posts, not to replies inside a comment thread.

b. Meta may change, restrict or withdraw API features, and your connection may expire or be revoked (for example if you change your password or remove PostAi in Instagram). We will try to notify you, but we do not guarantee that every comment will be answered or every message delivered, nor the time it takes.

c. We are not responsible for actions Meta takes on your Instagram account, such as limits, restrictions or suspensions, including those resulting from the content of your replies.

7. AI-generated content

a. Content is generated automatically by AI models from third-party providers (OpenAI and Google). It may be inaccurate, incomplete, unoriginal or unsuitable for your purpose, and similar requests may produce similar results for other users.

b. You must review all content, including AI-drafted replies, before publishing or saving it. You are responsible for how you use it.

c. Requests and results are checked by content moderation and may be blocked. You can report any result you consider inappropriate from the App.

8. Plans, credits and quotas

a. Free plan: shows ads. Each AI post (image and caption) is unlocked by watching a rewarded video, up to 3 posts per day. Captions alone are free up to a daily limit. Comment automation is not included.

b. Paid plans: Starter includes 1 automated Instagram account and 30 AI posts per month; Pro includes up to 5 automated Instagram accounts and 150 AI posts per month. Both remove ads and include a 7-day free trial with a reduced post quota.

c. Posts, credits and quotas have no monetary value, cannot be sold, transferred or exchanged for money, are not refundable and do not roll over from one period to the next. We may adjust the limits of the Free plan; changes to paid plans are handled as described in the Subscription Terms.

9. Subscriptions

Subscriptions are sold and billed by the Apple App Store or Google Play and renew automatically each month until you cancel them in your store settings. Refunds are handled by the store under its policies. Deleting the App does not cancel a subscription. All the details (prices, trial, renewal, cancellation, downgrades and price changes) are in our Subscription Terms, which form part of these Terms.

10. Prohibited uses

You must not use PostAi to:

• send spam, unsolicited bulk messages, scams, phishing or misleading offers;
• create or send content that is illegal, hateful, harassing, sexually explicit, violent or that exploits minors;
• infringe intellectual property, privacy or image rights, or impersonate others;
• collect or harvest data about Instagram users for purposes other than replying to them, or sell or share that data;
• connect Instagram accounts you are not authorized to manage;
• abuse, reverse engineer, overload or bypass the App’s limits, security measures, quotas or reward system, or use bots or scripts to obtain rewards;
• violate Instagram’s or Meta’s terms and policies, or any applicable law.

11. Intellectual property

The App, this website and their design, code and brand belong to Luhemusa Solutions. You keep your rights over the content you provide. You give us permission to process it only to provide the service. Subject to these Terms and the terms of our AI providers, you may use the content generated for you, including for commercial purposes.

12. Suspension and termination

You can stop using PostAi at any time, disconnect your Instagram accounts and delete your data (see Data deletion). Remember to cancel your subscription in your store settings. We may suspend or stop your access, block rules or disconnect accounts if you break these Terms, if Meta requires it, or to protect PostAi, our users or third parties.

13. Disclaimers

PostAi is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including that the App will be uninterrupted, error-free or that it will produce particular results (for example more sales, followers or engagement).

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the App, the content it generates or the actions of Meta or other third parties. Our total liability for any claim related to the App is limited to the amount you paid for PostAi in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to compensate us for claims, losses and costs arising from the content of your automated replies and messages, your use of Instagram through PostAi, or your breach of these Terms or the law.

16. Changes

We may update the App and these Terms. We will publish the new version on this page with a new date and, for important changes, let you know in the App. If you keep using PostAi after the changes take effect, you accept them.

17. Applicable law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. This does not deprive you of the protection of mandatory consumer laws of the country where you live.
